Commentaire de l'arrêt de Cass. 3ème civ., 11 octobre 2018, AJDI, juin 2019
A tenant benefiting from an exclusivity clause may require its landlord to enforce that clause against another tenant, even if the latter is not a party to the contract containing that provision. The landlord’s breach of the exclusivity clause constitutes a manifestly unlawful disturbance.
